PART TWO – MAJOR PENALTIES
The following actions published herein and imposed pursuant to the rules and regulations of the racing commissions of the various states and provinces are given full faith and credit and strictly enforced by the United States Trotting Association consistent with the provisions of USTA Rule 22, Sections 7 and 8 relative to RECIPROCITY OF PENALTIES. The fact that there is no separate action taken by the USTA in the form of a “ruling of reciprocity” shall not be construed as a failure to recognize and/or reciprocate with these published penalties. Please note that the following action is in an abbreviated form and that the USTA is not responsible for the accuracy or timeliness of reported penalties.

POSITIVE TEST- POST RACE
The urine sample collected from the horse “Paloma Ruiz” on February 4, 2022 identified the presence of the prohibited substances Oxymorphone, Oxycodone and Noroxycodone at a level of 3.0ng/mL and 0.057ng/mL and 0.333ng/mL respectively; The presence of Oxymorphone, Oxycodone and Noroxycodone in the horse “Paloma Ruiz” on February 4, 2022 is in direct violation of NJRC rule N.J.A.C. 13:71-23.1; Payment of the fine associated with this ruling must be received by the NJRC on or before February 7, 2023.

New Jersey Racing Commission (“NJRC”) licensee, Scott DiDomenico was the programmed trainer of the horse “Turbochargedpete” when it competed in the 10th race at Freehold Raceway on Saturday, November 19, 2022; The horse “Turbochargedpete” finished 2nd in the 10th race on November 19, 2022; Following its performance in the 10th race at Freehold Raceway on November 19, 2022, the horse “Turbochargedpete” was selected to submit blood and urine samples for analysis; The urine sample collected from the horse, “Turbochargedpete,” on November 19, 2022 identified the presence of the prohibited substances Oxymorphone and Noroxycodone at a level of 8.3 ng/mL; The fine associated with this ruling muat be paid by January 8, 2023.

Status as of 12/30/2022 – Subsequent Ruling – PA Code Title 7-203.11(e) Mr. George completed licensing requirements in the state of Pennsylvania. His suspension is hereby lifted as of Friday, December 30, 2022 and he is restored to good standing.

The payment associated with this fine must be received by the New Jersey Racing Commission on or before January 30, 2023.

Mark Silva was the programmed trainer of the horse TUXEDO BAY when he raced in the 1st race at the Meadowlands Racetrack on June 3, 2022. Following this race, TUXEDO BAY was required to submit blood sample for analysis. A report from Industrial Laboratories, identified the presence of the drug Phenylbutazone above the allowable limits.

PART THREE – WHIPPING VIOLATIONS
CHIODO, STACY L JACKSON, NJ YOB 1977

EXCESSIVE OR INDISCRIMINATE USE OF WHIP
Driver Stacy Chiodo is hereby issued a driving suspension for a period of five (5) days and is also fined the sum of five hundred ($500.00) dollars. Said suspension shall be served on five (5) consecutive New Jersey Racing Days and shall be served on December 18, 2022, December 23, 2022, December 24, 2022, December 30, 2022 and December 31, 2022. While driving #7 MYMONSTERSAREREAL in the 3rd race at the Meadowlands Racetrack on December 9, 2022, Ms. Chiodo during the stretch drive, did use the whip with more than wrist action and also did raise the whip above her shoulder in an exaggerated manner. These actions are in direct violation of the New Jersey Racing Commission rule regarding the restrictive use of the whip. The fine associated with this ruling must be received by the New Jersey Racing Commission on or before December 31, 2022.

WHIPPING OUT OF CONTENTION
While driving #2 Lawrence N in race 10 on 12/21/22 he whipped the horse after the finish. Mr.Ebersole is hereby fined $500. The penalty will be reduced to a fine of $300 if not appealed. O.S.R.C.-3769-17-17(I) 17-99 If the fine is not paid to the judge by 1/13/23 he shall be suspended.
HENDRY, ERNIE A MILLSTONE, NJ YOB 1968

EXCESSIVE OR INDISCRIMINATE USE OF WHIP
While driving #5 BAD MEDICINE in the 10th race at Freehold Raceway, Friday, November 25, 2022, driver Ernie Hendry did strike #5 BAD MEDICINE with his driving whip after the finish. The Board of Judges has determined that Mr. Hendry`s actions are in direct violation of N.J.A.C. rule 13:71-20.15(b)6. Having waived his right to a hearing before the Board of Judges driver Ernie Hendry is hereby issued a driving suspension for a period of five (5) New Jersey Racing days and fined the sum of five hundred ($500.00) dollars. Said suspension shall be served on January 6, 2023, January 7, 2023, January 13, 2023, January 14, 2023, and January 20, 2023 inclusive. The fine issued herein shall be received by the New Jersey Racing Commission no later than January 20, 2023.
KILLEEN, JACK J WASHINGTON, PA YOB 2000

INAPPROPRIATE USE OF THE WHIP
PA Code Title 7-205.409(c) While driving No. 8 GIVEN UP TERROR in race 12 on 12/30/22 at the Meadows, driver Jack Killeen did whip the horse using other than wrist and elbow action while in the stretch. Mr. Killeen is fined $200.00 which is due within 10 days of this ruling. Mr. Killeen has 10 days to appeal this decision to the Pennsylvania SHRC, Bureau of Standardbred Racing.
SMITH, JEREMY R WASHINGTON CH, OH YOB 1980
DTN on 12/30/2022 FINED: $750, DRIVING – 5 DAYS, 1/8/2023 THRU 1/12/2023
INAPPROPRIATE USE OF THE WHIP
OSRC 3769-17-17-B,C & L. While driving ##5 Soho Wallstreet A at the top of the stretch in race 1 on 12/30/22 at Dayton Raceway, Mr. Smith did whip the horse using other than wrist and elbow action, and also in an indiscriminate and exaggerated manner, (3rd offense). Mr. Smith is fined $750 and given a 5 day driving suspension (01/08/2023-01/12-2023), or just a $750 fine if not appealed. Mr. Smith has 10 days to the pay the fine, and 48 hours to appeal this decision to the OSRC.

INAPPROPRIATE USE OF THE WHIP
